Petrenko P. Bank Guarantees In Private International Law

This Dissertation is the first in domestic legal science to carry out the all round analysis of international relations of guarantee. Legal nature of such relations and their place in the private international law is defined in the thesis. The following key definitions are formulated: international relations of guarantee, bank guarantee in private international law, agreement for issuing bank guarantee. Specifics of the subjective structure of the international relations of guarantee, their object, subject, as well as grounds for emergence, change and termination are also analyzed in the thesis. Special attention is given to the qualification of guarantee, as well as determination of the law applicable to the international relations of guarantee and determination of the court, competent to hear disputes arising from such relations.
