Arshava I. Public Administration of the notary's development under the transformation of Ukrainian society

The object of the study is social relations in the sphere of the state administration of the notary activity in Ukraine. The aim of the study is to substantiate the theoretical principles of the public administration of notary development and on this basis to put forward the conceptual proposals of its improvement in the conditions of the Ukrainian society transformation. The scientific novelty of the obtained results lies in solving the scientific problem of substantiating the theoretical and methodological basis and working out practical recommendations on improvement of the state control in the sphere of notary activities aimed at guaranteeing the rights and freedoms of citizens under the conditions of significant changes in the legislation of Ukraine, the adaptation of national legislation to the norms of the European law. Тhe complex of the theoretical principles of the state administration of the notaries development in the conditions of the Ukrainian society transformation, in particular, the potential effect of notaries as an independent social institution on the state administration effectiveness, its integration into the European system of notaries, the proactive approach as an innovative tool to improve the state notary administration have been substantiated; the predictive ability of the notary activity with taking into consideration the proactive paradigm of the state notary administration has been established; the essence of the state administration of the notary development in the system of public (administrative) services in Ukraine has been defined. Improved: the scientific approaches to the multivariate state administration of the notaries in a society that is transformed; the theoretical basis of public administration of the notaries development, taking into account the trends of social relations transformations, political and administrative state systems, the notaries as a public institution in the Ukrainian society and on this basis the concept of notaries activity development in Ukraine has been suggested; the methodological basis of applying the foreign experience in the area of the state administration of the notary activities. Received further development: the modern scientific approaches to designing the structure and methodology of the effectiveness analysis of the Institution of notaries activities, the available scientific approaches to the problems of state administration of the notaries development in Ukraine; the concepts and categorical apparatus in the area of the state administration of the notaries development (the development of the complete algorithm of the efficiency analysis of the notaries functioning as an integral part of the state (public) administration has been suggested).
