The dissertation is devoted to comprehensive researching of the functioning features and implementation issues of the new generation biological human rights and freedoms in the modern state. We propose to introduce a new term to the theory of human rights - "biological rights". There were considered the development of these rights and their origins. There were distinguished the characteristic features of the investigation human rights. The biological rights were conditionally divided into general biological law and peripheral and the specificity of each is studied. We analyzed world experience and national sources of law that affecting the biological human rights. The place of biological rights is examined among others and they are compared with personal, social, economical, political. It is shown that moral and religious norms affected the biological rights. The author considers the current state of implementation, identifies problems that arise during the implementation of biological human rights and freedoms, their theoretical and practical aspect. It is demonstrated that nowadays the availability of human biological rights is not help to implement them perfectly but on the contrary can lead to eugenics and destruction of the human species, because modern science stops at nothing for the latest technologies and discoveries. The author considers the ways of overcoming the problems of the functioning and implementation of the biological human rights.
