Bazhanov V. Contractual legal relations in the field of the copyright law of Ukraine.

Thesis is an independent complete scientific work dedicated to the research of contractual legal relations in the field of the copyright law of Ukraine. It formulates doctrinal definition of the notion of copyright agreement, clarifies its legal nature and content, and provides the explanation of copyright agreements system in Ukraine. The peculiarities of the relations arising from the agreements in the field of copyright law are demonstrated through the analysis of the legislation in force and the practice of its application by ordinary and commercial courts. Drawbacks in regard to the regulation of the contractual legal relations in the field of copyright law are revealed. Namely, it is referred to the imperfection of legal regulation of the mechanism of copyright allocation in regard to works for hire, relations in regard to the collective management of copyright, the use of copyright objects by virtue of license as a type of agreement on the disposal of intellectual property rights, etc. The range of theoretical provisions and findings developing and improving the theory of contractual legal relations in the field of copyright law are defined as well as specific offers aimed at the improvement of the legal mechanism of contractual legal relations regulation in the field of copyright law are substantiated and enunciated. 7452
