Petryshyna-Dyug G. Problems of legal institualization of political parties on Ukraine.

The thesis presets the complex research the process of legal institualization of political parties in Ukraine according to the foreign experience and domestic specific of democratic institutes building. The author defines the notion of legal institualization of political parties, its sources (international agreement, judgment of European Court of human rights, Constitution, election legislation, special law, court judgments, statute of political parties) and on the base of the analysis of party legislation of foreign states defines five basic models consitualization and insitualization of political parties. The special attention is given to such important issues as procedure of creation and liquidation of political parties, their financing and mechanisms of their participation in the parliament activity. The procedure of creation of political parties in Ukraine is deficient and promotes excessive fragmentation of party system. The necessity of the implementation an additional criteria of individual participation the political party in the parliament election during last ten years is grounded. Author states that direct state financing of political parties with simultaneous increasing the transparency in this sphere is vital for democracy. The propositions on the improvement the reglament of the Verkhovna Rada of Ukraine, especially about minimal size of parliamentary group, the requirements to its internal structure, are made.
