Eroshenko O. The Legal Regulation of the Mandatory Proceeding upon the Legislation of Ukraine

The Thesis presents the complex exploration of the legal regulation of the mandatory proceeding upon the legislation of Ukraine. The conception of the mandatory proceeding, its legal nature and its characteristic attributes have been discovered. The Author proposes a number of requirements that can extend the list of grounds upon which the court order can be issued. The peculiarities of the legal regulation of separate stages of the mandatory proceeding have been analyzed; the experience of several foreign countries regarding the simplification of the civil legal proceeding has been generalized from the position of possible reception of some rules into the native legislation.
