Essay

The thesis is devoted to a comprehensive, systematic historical and legal study of the constitutions 1848 , 1849, 1850 and 1867 of the Austrian Empire and the Austro -Hungarian monarchy and especially their application in Galicia. Main stages and directions of constitutional development in Austria and Austria-Hungary in the second half of the nineteenth century, factors which influenced and caused peculiarities of constitutional lawmaking were found and investigated. Influence of historical austrian constitutionalism on the state and legal tradition of the Austrian and Austro-Hungarian empires peoples, including Ukrainian, the development of civil and political rights, parliamentarism, self-government was proved; peculiarities of the Austrian constitutionalism, contradictory character of constitutional process, implementation of the dominant legal ideas in the constitutional process; the main features of the formation of the Austrian constitution - the highest legal force, institutional role, stabilit, were highlighted.
