Lemeshko Y. Circumstances aggravating punishment under the criminal legislation of Ukraine.

The dissertation is devoted to the solving of the problematic issues of the aggravating circumstances accounting in sentencing. The legal nature, indications and criminal-legal meaning of the circumstances aggravating punishment have been investigated. Their interrelation with the circumstances mitigating punishment and qualifying (particular qualifying) indications of the corpus delicti has been determined. The criminal-legal characteristics of the factors predicted in the Part 1 Article 67 of the Criminal Code has been given. The propositions as to the improvement of the criminal-legal rules regulating the sentencing in the presence of the aggravating circumstances have been formulated.
