Mishchenko M. Criminal-Legal Protection of Cultural Property in Ukraine

The thesis is devoted to integrated and systematic examination of cultural valuables criminal protection issues in Ukraine, based on the provisions of the current Criminal Code of Ukraine, the theory of criminal law, developments of national and foreign legal experts. The concept, characteristic features and types of cultural valuables have been defined herein. Periodization and a detailed analysis of the main historical development stages of criminal legislation on cultural valuables protection are being pursued. All mandatory and optional elements of crime components that infringe on the cultural valuables as well as punishment for their commission are thoroughly being scrutinized. The peculiarities of classification of each of the crimes that infringe on the cultural valuables are considered particularly along with the problems of the reform of current criminal legislation in the sphere of cultural valuables protection. Based on the study results, the proposals regarding amendments to the criminal legislation have been elaborated, which provide for responsibility for infringement on cultural valuables.
