In thesis it is theoretically summarized and made the solution of scientific task which consists in identification and systematization legal measures of elimination main dysfunction legal arrangement of public procurement in the sphere of health protection. It is proved that public procurement is the universal, according to the subject, multifunctional and complex indirect measure of public regulation of economic relations that ensures the implementation of the aggregate public interests, combining the legitimate interests of the state and entities in the marketing organization for goods, works or services in order to ensure social needs. Analyzed in details the dysfunction legal arrangement of public procurement in the sphere of health protection. Worked out approach to a broader consideration of the specific needs of health care within the public procurement, determined the vectors of improving substantive law. Were revised universal legal remedies which have important legal significance on all stages of organization and conducting tenders. It is proposed to set new rules of planning trades and choosing the object in tender documentation. Were justified the necessity of introducing strategic procurement planning, improving the qualification of participants and evaluation of tender offers.
