Essay

The research thesis investigates theoretical and practical research of the institute of evaluation of proofs in civil process. First time the evolution of the institute of proof evaluation in civil procedures analyzed in terms of the Ukrainian lands in three periods of their development: proof evaluation based on mythological beliefs, proof evaluation based on theory of formal proofs and proof evaluation based on judge's belief. The institute of proof evaluation in the context of the structure of law of evidence is considered as general and functional legal institute.
