Hetmantsev M. Material proofs in civil process

In dissertation research it is carried out the complex thorough analysis of the main theoretical development in use sphere in civil legal proceedings of material evidences, it is considered the fixing mechanism in the legislation and settlements of all standard collisions and features of use of these provisions in practice that the contents and characteristic signs of material evidences define, and also regulate procedure of collecting, presentation, research of return of material evidences in civil legal proceedings. It is analyzed that in various historical periods, depending on the dominating doctrine and social-economic conditions of law application, the content of concept of "material evidences" changed. All sections and paragraphs of the thesis contain the comparative and legal analysis of signs of material evidences and ways of their research behind the legislation of other countries and in standard and legal sources of various branches of the right of Ukraine. Also it is proved the need of legislative improvements of procedure of research of material evidences for a videoconference mode which for certain reasons can't be delivered in a hall of court sessions for an assessment by court.
