Kurylyuk Y. Criminal responsibility for violation of the Border Guard duty rules

In this research for the first time origins and current status of social relations are analyzed, which are referred to the criminal responsibility for violation of the Border Guard duty rules on the vast of the State Ukraine, comparative law characteristic of this crime is done by the law of Ukraine and some other foreign states. The definition and social danger of the criminal violation of the Border Guard duty rules is determined, objective and subjective signs of the elements of the crime, covered by the Article 419 of the Criminal Code of Ukraine is researched, problems of assignment of punishment for committing this crime are concerned as well as defects of the current criminal law in the researched sphere are discovered and ways on their removal are proposed.
