Kucher O. Legal support of economic planning in the PRC

Research object: public relations which arise up in the process of planning of economic activity in PRC. Research purpose: ground of new positions about planning of economic activity in PRC, directed for subsequent development of perspective direction in science of economic right for Ukraine - economic right for foreign countries. Research methods: dialectical, historical and legal, formal and legal, interpretation of legal norms, system and structural, comparative and legal, statistical. Theoretical and practical value: results of complex research of the legal providing of planning of economic activity in PRC in the context of doctrine of economic right and practice of conduct of management on the stage of construction of "socialistic market economy" in this country, can be it is used for research of problems of the proper relations in Ukraine and perfection of national legislation. Research materials were utillized Committee of Verkhovna Rada of Ukraine on questions of industrial and investment policy at preparation of project of Law of Ukraine "About the state strategic planning". Substantive provisions are utillized in activity: Main economic administration of Donetsk city advice; Kievan district in m. Donetsk of advice; Donetsk commercial and industrial chamber, and also Donetsk state university of management at teaching of course the "Economic right for foreign countries". Scientific novelty: genesis of economic right for PRC is investigational. Found out lines, inherent on the modern stage to the economic right for PEOPLES Republic of China on the whole and in the field of planning. A planning mechanism is investigational, methods, types of planning, are exposed in PRC. The legal adjusting of activity of management organs is analysed on development and organization of fulfiling the plans in PRC, the system of organs and their plenary powers is exposed in the proper relations. Directions of the legal providing of combination of planning and market self-regulation are investigational in PRC. The analysis of generals is conducted about control and responsibility in the field of planning in PRC, their forms are investigational. Developed suggestion on perfection of positions in relation to planning of economic development in Ukraine, taking into account experience of PRC. Sphere of the use: subjects of initiation of bill; subjects of menage; higher educational establishments.
