Skreklia L. Cruelty as a Cross-Cutting Criminal Notion

New theoretical statements and amendments to Exceptional Part of Criminal Code of Ukraine in scopes of regulating responsibility for crimes, the essential element whereof the cruelty is, have been suggested. The inexpedience of usage in the Criminal Code of terms 'exceptional cruelty', 'torment', 'victimization', 'exceptional torment', 'abuse', 'wipe', 'painful and other actions debasing personal dignity of the person affected' that are violations of terminology unity and hence the legislative techniques drawback has been justified; the inconsistency of practice and valid Criminal Code of Ukraine regulations during realization of criminal qualification for commitment corresponding trespasses has been investigated.
