Eregyan А. The concept of crime and punishment in the sources of Law of Kievan Rus (IX-XII centuries): general theoretic aspect.

The dissertation covers the research of general theoretic aspect of the concept of crime and punishment in the sources of law of Kievan Rus in the period of IX?XII centuries. The content that was put into the concept of crime and punishment in law of Kievan Rus in the period of IX - XII centuries was analyzed and own authorial concept of crime and punishment that was inherent in law of Kievan Rus in the period of IX?XII centuries was formulated in consideration of the research of development of the concept of crime and punishment in native and foreign literatures. Causation was shown, that is social and political and socio-economic preconditions of formation of law in the analyzed period and their influence on the development of the concept of crime and punishment in law of Kievan Rus. The sources of law of Kievan Rus of IX - XII centuries were analysed and the content of actions that were considered as the most social dangerous and implicated serious punishment, i.e. were a crime, was disclosed. The types of punishment that can be considered as criminal in the modern consideration were analysed. It was established that the sources of law of Kievan Rus in the analyzed period were Customary Law, Codified Law and Ecclesiastical Law.
