Kudryavtseva O. Constitutional and legal framework for the protection of children's rights in Ukraine.

The thesis deals with issues of constitutional and legal framework for the protection of children's rights in Ukraine. We have studied the nature and content of the categories of "constitutional rights of the child", "constitutional - legal framework for the protection of children's rights", set the nature of their relations. The problems of the genesis of the approval of major conceptual approaches Ukrainian and foreign scientists regarding the protection of the constitutional rights of the child in the legal doctrine and practice in Ukraine, as well as identify its main stages. Determined that under a system of constitutional rights of the child in Ukraine should understand the ordered set of interrelated types of children's rights: 1) the subject - the right to life, protection of the dignity, rights and freedoms of citizens (for example, the right to form non-political organization and the right to individual and collective appeals), 2) on the Genesis - on natural (eg, the right to life) and derivatives (for example, the right to freedom of expression, to information), 3) the nature of education - basic (constitutional) and complementary (specifying) 4) content - for personal, civil, political, economic, social, cultural. Based on the results of this study, it is proposed to define in law the legal status nastsiturusa (unborn child), as well as the effective date them in their rights, which is the moment of separation of the fetus from the mother's body by birth.
