Prudnikov V. The content of the labor contract under modern conditions.

Thesis is devoted to the complex problem of the theoretical basis as to the content of the labor contract under market economy conditions and development of the democratic social legal state. In the thesis the subjective composition of these relations has been illuminated, it has been proved that only an employer with his unique ability to work, which can not be separated from his personality, creates gross domestic product, material and spiritual values, promotes economic development of the country. What kind of mechanism of the determination of the content of the labor contract has been proposed in the country, applied to a particular enterprise, institution or organization depends the economic power of the state, strategic way of its development and prosperity of its population and also relationship (democratic or totalitarian) between employers and employees. The determination of the content of the labor contract should be based on the rule of law, protection of the rights of the worker, balance of interests of his employee and the state taking into account positive and negative consequences that brings to social life the globalization. In the work the problems of the interdependence of the economy and law and their influence on the content of the labor contract has been investigated. The problems of the legal awareness of the labor contracts parties, theoretical-legal content of the personal database as the element of the labor contract content, paradigm of the determination of the labor function of the worker on the base of the competent approach have been illuminated too.
