Moskalenko K. Producer Contract in the Sphere of Music Show Business: Civil-Law Aspects

The author comes to the conclusion that producer contract can have either the nature of labour contract or civil contract. In case if producer contract is a civil contract, it can be defined as mixed civil contract, that can contain the elements of the following contracts: contract of service, contract of delegation, commission contract, agency contract, contract of transfer of exclusive proprietary intellectual property rights, license agreement, contract on creation of the object of intellectual property by order etc. The dissertation deals with the question of legal status of the parties to producer contract, in particular - producer, performer and investor. The author outlines the list of the essential, usual and accidential contract terms, justifies the conclusion on the form of producer contract.
