The historical genesis of regulation of criminal responsibility for the harm caused in a state of physical or mental compulsion is researched in the dissertation. The basic criminal-legal aspects of the notion of physical or mental compulsion are defined. The legal nature of physical or mental compulsion as a circumstance excluding criminality of act is analyzed. Special attention is paid to the determination of notions of "compulsion" and "violence" as well as their correlation.
