Budurova H. Economic-legal Regulation of Commercial Use of State Property

The thesis is devoted to the research of economic-legal regulation of commercial use of state property. On the basis of current legislation analysis and doctrinal regulations on profitable use of state property there are offered narrow and broad approaches to the concept of commercial use of state ownership objects with the determination of the features of such use. The relations arising in the commercial use of state property and the basis of their classification are investigated. The substantial elements of legal relations on the commercial use of state property are investigated. An object description of these relationships is provided; a division of state property into commercial and non-commercial objects is proved and criteria-principles of election of the priority way of use of the object in accordance with its functionality are proposed. The system and powers of the authorities on state property are investigated, the perspectives and disadvantages of the implementation of the holding system in the management of state property are analyzed. The main forms of commercial use of state property are marked out and described. Special attention is paid to the issues of economic and legal support of commercial use of state property by the creation of commercial state enterprises, conclusion of business contracts, functioning of the maritime economic complex.
