The dissertation is devoted to the investigation of the principles of the appropriate fact-finding procedure in terms of the Ukrainian judicial enforcement procedures, considering the requirements of the European Court of Human Rights for appropriate proving. The principal approaches to the comprehension of judicial cognitive actions, characteristics of the fact-finding consequences and the concept of judicial proceedings models were analyzed on a case-by-case basis. The aforementioned principles presuppose equality of the proving opportunities of the litigants, the application of the adversarial proceedings model, use of the applicable evidence by the court, and reasoning of legal judgments. A characteristic of the compliance of the abovementioned provisions with the Ukrainian legal system concerning the proceeding fact-finding process is provided.
