Vasilin N. Criminal Liability for Assisting Commission of a Terrorist Act.

Dissertation research is the first monographic work in Ukraine dedicated to issues of criminal liability for assisting commission of a terrorist act. Definition of generic and direct objects of assisting commission of a terrorist act is specified. Subject of crime in such forms as arming and training a person with the goal of committing a terrorist act is defined. Conclusion that Article 258-4 of the Criminal Code of Ukraine has to cover all forms of assisting commission of a terrorist act is substantiated; it is proposed to define objective side of the crime set that is reviewed as committing acts aimed at assisting commission of a terrorist act with the purpose of separating this crime from complicity to commit terrorist act, clear indication of the moment of crime completion. Necessity of securing liability in Article 258-4 of the Criminal Code of Ukraine for not promised beforehand concealing of terrorist act without exception for close relatives is proved. Necessity of decreasing age of criminal liability for assisting commission of a terrorist act to 14 is substantiated because liability age for terrorist act starts from 14 years and assisting its commission are in fact preparation acts towards it. Necessity of supplementing Article 258-4 of the Criminal Code of Ukraine with a stimulating norm about release from criminal liability in case of suspension or prevention of terrorist act by a guilty person by timely reporting to relevant government bodies or by other means is proved.
