Essay

The legal nature of a judicial precedent, its sense, characteristic features and types are studied. Specifics of the formation and legal force of a judicial precedent in space, in time frames and applicability to a range of persons are analyzed. Strengths and weaknesses of a judicial precedent are estimated, its role and place in the system of forms of law is specified. Forms of judicial precedent in common law and continental law systems, in jurisprudence of the European Court of Justice and of the European Court of Human Rights are researched.
