Karanikola O. Intentional murder of a hostage or a kidnapped person: criminal-legal, criminological characteristics and counteraction

Objective and subjective features of the crime the liability for which is provided by p. 3 p. 2 of Article 115 of the Criminal Code of Ukraine are viewed; the drawbacks of the norm under analysis are singled out and the ways of their elimination and perfection of the provisions of the Criminal Code of Ukraine in force are suggested. The paper highlights a number of theoretical and practical issues concerning criminological characteristics of the intentional murder of a hostage or a kidnapped person. The author suggests a system of preventive measures against intentional murder of a hostage or a kidnapped person. A new wording of p.3 p. 2 of Article 115 of the Criminal Code of Ukraine is suggested.
