Ilyina Y. Legal basis for appeal against the actions of notaries in civil proceedings

The essence and the legal nature of judicial appeal against the actions of notaries in civil proceedings were disclosed. The characteristics for appeal against the actions of notaries in civil proceedings are argued due to some similarities in judicial and notarial activities in the field of civil jurisdiction, demonstrated in tasks, substance, procedural nature (form), the presence of common institutions, normative regulations, etc.; attention was paid to the specific legal and procedural status of a notary, who is a special member of Civil Procedure. As the appeal against the action of notaries in civil proceedings, it was suggested to understand the procedure of appeal to the courts for protection of their rights and interests protected by the law, if they were violated with the actions of notaries, as well as review of cases involving sophisticated notarial act or refusal of their implementation, notarial acts in civil proceedings by the court.
