Pogrebnіаk N. The Constitutional-legal status of the Аpparatus of the Verkhovna Rada of Ukraine.

In the dissertation the theoretical foundations of the constitutional-legal status of the Apparatus of the Verkhovna Rada of Ukraine has been formulated and tendencies of its development have been denoted. The dissertation is devoted to the new problem which has not been developed comprehensively previously, namely, formation, organization and functioning of the Parliamentary Apparatus in Ukraine. There on the base of the works of historians, philosophers and lawyers and normative materials the content and properties of the notions such as "constitutional-legal status of the Apparatus of the Verkhovna Rada of Ukraine" have been disclosed, the historical-theoretical and organizational and legal problems of the Parliamentary Apparatus in Ukraine activity have been considered. Тhe regularities of the evolution of the institute of the Parliamentary Apparatus in Ukraine beginning from the early stage of the formation of parliamentarism have been revealed. On the base of the broad approach three components of periodization of the evolution of the representative (legislative) institutions Apparatus on the territories of Ukraine, namely, early, middle and late have been separated. The problem of the place and role of the Apparatus in the structure of the Parliament and state mechanism as the auxiliary structural unit of the public power body providing execution by the state body of its authorities; part of the state Apparatus; subject of the constitutional-legal relations has been considered. The concept of the Apparatus of the Parliament as the complex scientific category in the institutional, functional and organizational aspects has been formulated. The characteristic of foreign experience of the organization and activity of the Apparatus of the Parliament on the assumption of the elemental composition of the legal status has been given. It has been proposed to take into account the possibility of the implementation of the positive European and international practice under the condition of our country Parliamentary Apparatus functioning. It is established that the experience of functioning of the Apparatus of the Parliaments of countries having sufficiently developed traditions of parliamentarism (Germany, Great Britain, Poland) is very valuable for Ukraine. The classification of the types of the Apparatus of the Parliaments has been given.
