European standards of a fair trial and their implications for criminal law combating injustice in Ukraine and international experience of criminal responsibility for by a judge (judges) knowingly illegal sentence, decision, ruling or selfish motives are characterized in the work. Objective and subjective elements of a crime under Art. 375 of the Criminal Code and the content of aggravating circumstances of the crime under Art. 375 of the Criminal Code of Ukraine are analyzed by the author. The special signs of obviously unjust judgment, special subjects of the crime (professional judge, the investigating judge, people's assessor, juror) are presented in the thesis. A special attention is paid to the characteristics of his selfish motives aggravating circumstances. The author has presented a definition of the concepts "motive" and "selfish motive" and has subjected scientific analysis of criminal sanctions for a judge (judges) knowingly unjust judgment and other appropriate sanctions regulations Section XVIII of the Criminal Code are presented. On the basis of the results proposals for improving the legislation of Ukraine criminal liability are developed in the study.
