Gerasimenko N. Legal status of municipal banks

Research object: public relations, which are folded in the process of creation, functioning and stopping of activity of communal banks. Research purpose: development of theoretical positions and recommendations in relation to the improvement of legal status of communal banks in Ukraine. Research methods: dialectical, system-structural, formal-logical, logiсal-legal, historical, legal analogies, sociological, scientific cognition. Theoretical and practical value: it is deep and improved theoretical pictures of essence of economic and legal relations in relation to creation and activity of communal banks. Can be drawn on research results for subsequent development of the proper legislation, and also at the improvement of normative base, in law enforcement activity, in an educational process. Were drawn on the got results at development of project of Law of Ukraine "About perfection of legislation of Ukraine in relation to legal status of communal banks", recommendation, in relation to fixing of the special economic and legal status of communal bank it was used the National bank of Ukraine, results are inculcated in-process the All-Ukrainian association of organs of local self-government "Association of cities of Ukraine", in the educational process of Academy of municipal management. Scientific novelty: found out pre-conditions of creation of communal banks; expedience of including of treasury maintenance of local budget is grounded to economic plenary powers of communal banks; it is offered, to confer the right communal jars to give interest-free credits communal enterprises. Position is improved in relation to determination of concept "Communal bank"; subject composition of founders (participants) of communal bank; management organs in communal jars. It is developed: criteria of arrangement of rights and duties of communal banks; sphere of activity of communal bank; legal status of communal bank. Sphere of the use: subjects of initiation of bill; organs of local self-government; higher educational establishments.
