Todua T. The Legal regulation of commercial mediation in the field of management

Research object: public relations which arise up in relation to commercial mediation in the field of management. Research purpose: development and ground of suggestions on perfection of the legal adjusting of commercial mediation in the field of management on the basis of complex research of theoretical bases, legislation of Ukraine and foreign countries, judicial practice. Research methods: dialectical, analysis of the systems, historical, comparatively legal, logic analysis. Theoretical and practical value: deep and improved in science of economic right theoretical developments on the legal adjusting of commercial mediation in the field of management; developed suggestion on perfection of national legislation in this sphere. Were drawn on the got results at development of project normatively legal act on perfection of legal regulation of commercial mediation in the field of management, which is directed in Verkhovna Rada of Ukraine, and also utillized in activity of the Executive committee of city advice of city Torez, Main administration of justice in the Donetsk area. Scientific novelty: held the periodization of the development of legal regulation of commercial mediation in the field of management in Ukraine. Proposals to improve the termbase related research by clarifying the concept of "Commercial mediation" and introductions of concept "principal". The order of execution, performance and termination of the agency agreement is considered. Substantiated the proposals for the improvement of conditions of the agency agreement and the term of the agency agreement. Proposals for optimization of the calculation and the procedure for payment of agency fees, rights and obligations of the parties of the agency agreement and the termination of the agency contract. Finalized provisions for regulation of monopoly agency relationship, subagent agreements and responsibilities of the subject being represented by the agent. Researched the basic direction of harmonizing the law of Ukraine with the EU law in the field of commercial mediation. Sphere of the use: subjects of initiation of bill; subjects of managements; higher educational establishments.
