The Thesis solves the problem of determining general theoretical basis of regulation of concession of seaports due to civil law contracts. In particular, this work includes established legal aspects of the concession agreement about seaports, it provides the doctrinal concept of the concession agreement about seaport; it also determines common signs of the concession agreement as a generic term, identifying the features of civil contract, the legal characteristics of the concession agreement about seaport as well as the features of the concession agreement about seaports. This work also defines its legal purpose, the essential terms of agreement and form of the concession agreement about seaports, it clarifies the legal status of parties of the concession agreement about seaports, their rights and obligations; it determines the features of the concession agreement about seaports, especially its terms and responsibilities of the parties. Moreover there are formulated the suggestions for improvement of the existing legislation governing the concession agreement about seaports. In particular, the thesis defines the status of the study of the problems of the concession in civil law and its main directions, as well as main scientific approaches to the concession agreement about seaport. There are given various approaches that exist in the law on this subject, in particular, in the civil law, economic and administrative law. The Thesis determines the specific features of the concession agreement about seaports. It also studies the peculiarities of the legal status of parties of the concession agreement about seaports and focuses on entering into the concession agreement about seaports and features of the competition. There is also disclosed the main purpose, conditions and form of the concession agreement about seaports. It includes determinations of the rights and obligations of the parties of the concession agreement about seaports. The main attention is put on the particular fulfilment of the concession agreement about seaports, its terms and responsibilities of the parties.
