Essay

The object is the phenomenon of judicial and legal policies. The goal is to reveal the features of the formation and implementation of the judicial policy in the context of political modernization. The methods are dialectical, system approaches, political, historical, structural and functional and institutional. The thesis is devoted to features of the formation and implementation of the legal and judicial policy in a political modernization. It is disclosed the conceptual approaches and methodological bases of research the legal and judicial policy, investigated the background and towards the institutionalization of constitutional control as a factor in the effects of modernization of the judiciary, the court clarified the development of constitutionalism in the framework of non-Western models of political modernization, analyzed the essence of judicial activity and its impact on the political and modernizational transformations, modern trends of development policy of judicial powers and identifies the background and current priorities of judicial and legal policy in Ukraine. It is shown that justice is an area of high importance, in terms of goals, values and means of political modernization, in terms of objective need for large-scale modernization transformation of the political system is designed to ensure the court the legal nature of the reforms taking place in society and its political sphere. A strong, independent and developed a judiciary that enjoys the trust, is an institutional prerequisite for successful modernization. Application spheres are legislative activities, judicial decisions on political issues, training courses.
