Komarnytskyj M. Criminal Liability for Illegal Mining

The dissertation is dedicated to the research of issues of criminal liability for illegal mining. Taking into account achievements of doctrine and developments of law enforcement practice an in-depth criminal law analysis of objective and subjective elements of the main crime set "illegal mining operation" is conducted. The content of aggravating circumstances used to differentiate criminal liability for illegal mining is established, and specific features of qualified crime sets formed by them are defined. Differentiation of illegal mining operations from related crimes sets and from administrative offenses sets is realized. Specific features of punishment for illegal mining operations and the purpose of its imposition are revealed. Based on the results of the conducted study proposals for improving the Criminal Code of Ukraine and the Code of Ukraine on Administrative Offences are formulated.
