Kopanchuk V. Criminal and legal life protection of persons in connection with fulfilment of special authorities (Art. 348, 379, 400 of Criminal Code of Ukraine).

In Thesis is performed a comprehensive theoretical analysis of Art. 348, 379, 400 of Criminal Code of Ukraine ("infringement on life of persons in connection with fulfilment of special public authorities on law enforcement") during historical process of legislation development intended to defend the representatives of law enforcement bodies within the period of IX-XXI centuries in Ukraine. The regulations of international legal acts and current criminal legislation of some foreign countries on life protection of the persons of law enforcement bodies are analysed; and the definition of such activity is given. Objective and subjective features of constituent elements of crimes, stipulated in Art. 348, 379, 400 of Criminal Code of Ukraine are researched and the definition of the notion "infringement on life of persons in connection with fulfilment of special public authorities on law enforcement" is given. System analysis of sanctions in appropriate regulations is performed and certain conformities of its structure are set up. On the basis of analysis of judicial practice, current legislation and scientific sources the distinct features of criminal and legal model "infringement on life of persons in coimection with fulfilment of special public authorities on law enforcement" are discovered; and certain offers on improvement of regulations of Criminal Code of Ukraine (Art. 115 - supplemented with sec. 3 and Art. 63 - supplemented with sec. 3) are made.
