Essay

In this dissertation for the first time in the national historical legal science fully and systematically a comparative research was carried out of the formation and development of Ukrainian and Russian criminal law in XI-the first half of XVII century. In this dissertation, the analysis was made a historiographical of the problem, revealed methodological principles of the investigation, clarified the sources of Ukrainian and Russian criminal law, set up common and different features of the definition of crime, types of crime, the institute of punishment in Ukrainian and Russian criminal law of the indicated date. It was found out, that the development of Ukrainian law was influenced by Russian norms, Polish and German law, Russian - by Byzantine norms, Tatar and Pskov law, and Lithuanian Statute. Particular attention was paid to identify regularities and peculiarities of the formation and development of Ukrainian and Russian criminal law. It was determined that the criminal law of Pskov and Novgorod is a kind of peculiar (northern) type of Russian law.
