Rykova O. Economic legal regulation of relations in the sphere of appearance and realization of maritime claims

The thesis is devoted to research of economic legal relations in the sphere of appearance and realization of maritime claims that will promote social economic order in the field of merchant shipping, effective settlement of maritime disputes and generally positively affected on the national economy. In this work it is determined that a maritime claim is based on the law and / or contract, expressed in writing the claim of natural person or legal entity, public authority or local authority, which arises in the economic, civil or labor relations in the sphere of merchant shipping associated with the operation, construction or other measures with respect to the ship, has derived from the nature of the rights of the responsible authority in the obligation, the employment relationship, property law. Legal institute of maritime claims of subjects of economic legal relations is defined as set of legal rules of economic and economic procedural law that provide the appearance, producing, security and execution of maritime claims of subjects of economic legal relations, contribute to realization and protection of their rights and interests. It is argued the necessity of Ukraine’s accession to the International Convention on the Arrest of Ships (Geneva 1999), that will expand the list of maritime claims and positive impact on the economic order as a whole, since it would ensure that the requirements of more legal entities, including and those requirements that relate to the public interest, disturbed by the use of the ship.
