Yarmola A. The Codes of Ukraine: general theoretical aspects.

Dissertation is devoted to the general theoretical analysis of the codes of Ukraine, since there exists the necessity of bringing them into conformity with international legal standards, of improving their quality and making them an effective regulator of social relations under current conditions. The research highlights the attributes of a code, its concept as a codifi ed law that embraces the main parameters of the normative legal field, the institute or other system organization within the subject-matter of legal regulation; the classifi cation of codes is made, the need for studying the codes of substantive law as well as of procedural law is raised, since such a differentiation refl ects integrity and completion of legal regulation. The author presents the attributes of substantive and procedural codes, formulates the notions “substantive code” and “procedural code”. Given the main technical and technological requirements for the codes of Ukraine and their conformity to the mentioned requirements; the shortcomings and defects of substantive and procedural codes of Ukraine are established. The defi nition of the concept “method of code’s defects elimination” is presented; the main methods of defects elimination in substantive and procedural codes of Ukraine are analyzed.
