Shevchuk I. Law-creating errors in the laws of Ukraine: general theoretical aspects.

Dissertation is devoted to the general theoretical analysis of law-creating errors in the laws of Ukraine, revealing their regularities and peculiarities in the laws of Ukraine as well as to ascertainment of the methods of their prevention and elimination. The author highlights the main attributes of law-creating errors and on their basis formulates the defi nition of the concept “law-creating error” as well as differentiates the concepts “error of law”, “judicial error”, “law-creating error”. For singling out meaningful and formal errors there have been chosen technical and technological requirements addressed on the laws and other sources of law that simplifi ed their revealing in the laws of Ukraine and helped to draw up a typological chart of law-creating errors. By this chart the author revealed their peculiarities and set out the most effective methods of their prevention and elimination. Among the methods of prevention and elimination of meaningful and formal errors, the author names law-making technique and technology as well as formalized rules of law-drafting that embody technical and technological requirements addressed on the laws.
