Karelova H. Criminal liability of the legal positions of the Constitutional Court of Ukraine.

The thesis provides a comprehensive scientific study of criminal liability in the legal positions of the Constitutional Court of Ukraine. There were defined the general characteristic, the legal nature of the legal positions of the Constitutional Court of Ukraine, there was revealed their role in the system of sources of domestic criminal law. It was stressed on the importance of thecase-law of the European Court of Human Rights for legal positions of the Constitutional Court of Ukraine on the criminal liability. The basic approaches to the understanding of criminal liability in the legal system of Ukraine were developed. The analysis of the legal positions of a sole body of constitutional jurisdiction in Ukraine on criminal liability within the limits of the implementation of systematization was provided. The peculiarities of the effect of the legal positions of the Constitutional Court of Ukraine on the rule-making and enforcement practices were substantiated. Based on the results of a study there were developed and formulated the appropriate proposals on the introduction of the amendments to the Constitution of Ukraine, the Criminal Code of Ukraine, the Criminal Procede Code of Ukraine.
