Zadnipryana M. Harmonization of legal responsibility principles of Ukraine and European Union

Thesis is devoted to harmonization of legal responsibility principles in Ukraine and European Union. Harmonization of legal responsibility principles is a difficult assignment, it's realization demands not only doctrinal understanding of the essence, approaches to classification with the aim to define harmonization basis, but needs fixation in political, program and special normative legal acts of general grounds, rules, institutional mechanism, as well as of the penalties for improper realization of different element of state legal reforms, acts of Ukrainian legislation. In the thesis have been analyzed domestic and foreign approaches to classification of legal responsibility principles, having practical and theoretical importance. The essence of legal responsibility principles and main approaches to their introduction into Ukrainian legislation using special modes of legislation harmonization and adaptation has been described on the basic classification by persons, that may be object of legal responsibility principles application. Here we have reviewed the list of main principles, being obligatory for the analyzed persons, as well as specifics of legal responsibility principles, fixed in European Union legislation acts, international treaties, developed by court practice of the European Union.
