Karpenko I. Special situations of complicity in the crime under the criminal law of Ukraine

The dissertation includes a comprehensive theoretical research of the special situations of complicity in the crime. The definition of special situations of complicity in the crime is formulated, the range of such situations is determined and approaches to their systematization are offered. The criminal legal description of some special situations of complicity in the crime is made on the grounds of analysis of regulatory, law enforcement and theoretical orientations. Such situations are: conspiracy to commit a crime, complicity in crimes with a specific point of completion, complicity in a crime in case of the transformation of criminal behavior on the part of the executor (co-executor), complicity in the crime in excess of one of the accomplices, complicity in the crime in the presence of voluntary refusal. The problems in their legislative regulation are found, and approaches to the qualification of appropriate situations are reviewed.
