Essay

It was found out that the basis of the principle of autonomy interpretation is Vienna Convention on the Law of Treaties as of 23 May 1969 (hereinafter - VCLT). The clause 4 of the article 31 of VCLT stipulates as an exception to the general rule that the ordinary meaning of a certain term should prevail, but if the parties meant "special content", the term may gain another meaning. Art. 5 od VCLT stipulates that while interpreting the constituent act of an international organization or any treaty adopted within an international organization the specific rules of this organization may be taken into consideration. This allows autonomous approach to interpretation in the context of the European Convention on Human Rights (hereinafter - ECHR).
