Tereshenco V. Civil legal consequences of unauthorized construction.

The dissertation is the first comprehensive study of civil legal consequences of unauthorized construction. Historical prerequisites of the formation of the institute building were analyzed and the legal consequences were of unauthorized construction determined. The changes in the position of the legislator in determining the consequences of unauthorized construction, which occurred in the process of development of the legislation of the Russian Empire, the Soviet and in modern period were investigated. Actual state of legal regulation of building (construction) under the civil legislation of Ukraine was determined, as well as the criteria, types and forms of unauthorized construction were set out and disclosed. The grounds of occurrence of “negative” private legal consequences of unathorized construction for the developer and their essence were ascertained. Were analyzed the Reasons of occurrence of “negative” private legal consequences for the developer of unauthorized construction and ascertained their essence. Proposals for improving the legislation of Ukraine conceming legal regulation of relations, arising from unauthorized construction, were introduced.
