The thesis is an independent complete scientific research devoted the procedures of reviewing by the courts of all instance cases of recognition transactions null and void. The work systematized guiding judicial practice in cases of invalidation of transactions, defined subject composition aspects of the case to invalidate the transaction with the defect of will; determined the object and methods of proving; studied the procedure of determining jurisdiction, suing for the invalidation of the transaction with a defect of will, determined the order of calculation of the claim and the court fee, studied the problematic issues of content claim for recognition of transactions null and void on the grounds of certain st.st.229- 233 of the Civil Code of Ukraine; formulated the proposals and recommendations for improving the provisions of the Civil Procedure Code and other acts of national legislation.
