Domanska M. Procedure in changing the legal status of an individual in civil Procedure Law of Ukraine.

The dissertation is devoted to complex research of the problems in considering and deciding court cases to change the legal status of an individual in a civil proceeding Ukraine. From analysis of current legal system and obtained practical results procedural-legal nature cases of changing the legal status of an individual were researched, detail of the grounds on which an individual may be restricted in a civil capacity or incapacity recognition were analyzed. The problems arise at the stage of the proceedings and preparing of the case for trial in cases of changing the legal status of an individual were scrutinized. Attention is paid to identifying the persons involved in the case, clarifying factual circumstances and range of evidence confirming them in matters under consideration by the author. Procedural order of adjudication of changing the legal status of an individual and the requirements that relate to the judgment and its features in these cases were studied. The theoretical sources and the basic problems that arise in practice were analyzed. The conclusions and suggestions for improving the current legislation and to solve existing problems were proposed in accordance with the results of scientific research.
