Osadcha A. Special subject of crime: genesis, functions, problems qualifications.

The dissertation is devoted to the complex research of such problem as special subject of crime. The genesis of the doctrine of the special subject of crime is investigated in the pre-Soviet, Soviet period and while Ukraine is an independent state. During the study, specific novels on the matter of special subject in the current Criminal Code of Ukraine were analyzed. Special attention was paid to the definition of the special functions of the subject of a crime and the elucidation of their impact on criminal legal relations. The Dissertation also features the possibility of complicity in crimes with a special subject, specific skills and elements of the crimes with a special subject, it also analyses an overcoming competition of the rules when qualifying such crimes. Proposals for improving the legal rules, which regulate responsibility of special subjects crime, are provided.
