This work for the first time in national legal literature provides a comprehensive analysis of civil protection of intellectual property rights in the field of public health. The general description of the legislation related to intellectual property rights protection in the field of public health is provided. The legal restrictions of rights of the subjects of legal relations in the field of public health in respect to the intellectual property rights objects are characterized from the standpoint of the public interests priority. Characteristic features of legal protection of intellectual property rights objects in the field of public health are revealed. The nature of property rights in the intellectual property rights objects is determined through the prism of specificity of the field of public health. The forms of infringement and abuse of intellectual property rights in the field of public health are defined. The main drawbacks and advantages of the system of intellectual property rights protection in the field of public health are highlighted. The recommendations are provided on improvement of legislation in terms of harmonization of intellectual property rights and rights in the field of public health.
