The dissertation is a special complex research of theoretical and practical problems of legal regulation of custody and guardianship as a form of care for orphans and children deprived of parental care. The thesis identified and characterized the stages of formation and development of the institute of custody and guardianship; the peculiarities of the legal regulation of the institution of custody and guardianship over the orphans and children deprived of parental care according to the current legislation of Ukraine. The concept and legal contents of guardianship as a form of placement of orphans and children deprived of parental care is defined. Extrajudicial procedure of establishment of custody and guardianship over orphans and children deprived of parental care is researched. The legal nature of cases concerning guardianship and custody of orphans and children deprived of parental care is explored; the peculiarities of opening of proceedings and proceedings in the case before the court hearing concerning guardianship or custody of orphans and children deprived of parental care is discovered. The peculiarities of the judicial order of establishment of guardianship over orphans and children deprived of parental care are defined. Suggestions on improvement of current civil procedural, civil and family legislation in the part of establishing of custody and guardianship of orphans and children deprived of parental care in the judicial order are formulated in the article."
