Malolitneva V. Legal regulation of government procurement

Research object: public relations related to the implementation of public procurement. Research objective: development of theoretical provisions on the legal regulation of public procurement subject to the processes of EU integration and WTO, preparation on this basis, proposals for improvement of economic legislation. Methods of research: dialectical, formal-logical, historical method, comparative legal method, analytic-synthetic, systematic and structural, logical-legal. Theoretical and practical value: for the first time in Russian legal science carried out a comprehensive scientific study of the problems of legal regulation of public procurement on the basis of which relevant scientific guidelines and proposals on improvement of legislation in this area. The proposals formulated in the thesis, approved for use in legislative activity of the Verkhovna Rada Committee on economic policy; included in the enterprise "reverse auction", in the development of strategy of activity of LLC "AWACS co., LTD.-K". Scientific novelty: an analysis of the regulatory framework for public procurement and developed proposals to address certain shortcomings. Examines the legal form of public procurement with evidence of the benefits of the implementation of centralized and unified procurement. Peculiarities of application of WTO law in the field of public procurement. Researched legal means of protection of economic interests of the state in the framework of the WTO Agreement on government procurement. Suggested promising directions of adaptation of Ukrainian legislation to WTO law in the field of public procurement. Peculiarities of legal regulation of public procurement in the EU. Given a legal assessment of the possibilities of adaptation of Ukrainian legislation to the EU legislation in the field of public procurement. Identified areas of improvement of legislation of Ukraine with public procurement in the context of international commitments to the EU. Scope of use: the subjects of legislative initiative, the subjects of enforcement activities, the business entities; institutions of higher education.
