The thesis is devoted to the historical and legal problems of defining the role of judicial precedent in the sources of law in Ukraine during the 1991-2010 biennium. Investigated the essential and fundamental concepts of meaningful content "source of law" and "legal precedent" that is revealed in the process of historical development in different jurisdictions modernity. Author's definition of judicial precedent, which includes both judicial activities and specific results of such activities - legal provisions.
